I’ve never liked reduced sentences on plea deals. Either he did it or he didn’t. If he did, put him in jail the same time that someone who got convicted is serving.

Unles he is a total frick up in prison, he will probably parole out in about 1.5 yrs. not counting any previous time-served, or at least he would in my state.

I've seen way worse attempted murder counts, most with a gun involved, get about 10 years. Personally, it looks like he kind of got hit hard in sentencing when looking at the circumstances.

Yes, any slammed dunk case like this deserves harsher punishment.

I think they usually make people do at least 1/3 of their time before they are up for parole. It might be more but I definitely don’t think it’s less than that.

I read that he was already in prison for the last 300 days since the arrest. Does anyone know why? Was he denied bail? Wouldn’t that be surprising considering the case? The other option would be that he didn’t have money to cover bail which seems even more unlikely.

If they didn’t exist, no one would ever take a plea, and people would be waiting 5 years for trial, in jail, on petty offenses. That or you could just enjoy a monumental hike in your taxes so the state could afford to pay all the additional prosecutors and PDs needed to litigate these cases. And more judges. And more jails to hold all these people.

8 years is a long time regardless. Although I doubt he serves even half of it in prison.

Not commenting on whether or what this guy did, don't really know.

But commenting on the situation and our system.

This case is prosecution/DA playbook to the tee.

This is how our justice system works. DA overcharges, Assistant D.A. agrees to drop the over-the-charges in a plea bargain...deal accepted.

The state and public has put so many laws on the books to use as ammunition against defendants without having to prove anything in court.

They can dangle 300 years in prison in front of your eyes for one crime...because every step of the crime is now a crime in and of itself that carries 20 years.

So instead of...we're charging you with attempted murder...it's, illegal use of this or that, breaking and entering, trespassing, burglary, assualt, battery, assault and battery II, assault and battery III, attempted mayhem, kidnapping, false imprisonment, etc.

Common law used to have 6 Felonies.

Now there's a million.

Easy way to plea-bargain defendants into submission and move on without a trial or having to prove jack squat.

That's America's Due Process...overcharge to avoid a courtroom and a jury...for a) too many cases and b) lack of evidence.

That or he couldn’t afford it. Bail with those charges is going to run several hundred grand more than likely, very possibly more

Very true. The charges they had him dead to rights on would have likely carried a longer sentence, if convicted, than his plea deal. So now they get a plea deal to attempted murder and comparable sentence to what they had with agg assault, robbery, child endangerment, etc
