If I remember correctly, the death penalty is given to programs that were already under probation for previously committed infractions and were essentially caught again.

Baylor was not under probation at the time.

that was just a rule that they made to get it down in the actual rule book

the death penalty can, and has, been given out outside of the repeat offenders clause

I doubt it, after reading the article the violations against Briles were done by Baylor, in an attempt to avoid paying him his buyout. Briles is being cited for letting his strength and condition coach handle discipline

The football team wasn't but the athletic department was.

Haven't been to Waco in a while I see.

FWIW, Baylor has cleaned house of everyone involved except for the Board of Regents and that is where they need to get to work chopping heads.
