Is Ackman right about Herbalife?

Some of you may have noticed from recent articles that the Ackman vs HLF is moving back into the spotlight. Both Sides of the argument seem intriguing. HLF claims that they actually have a market outside of their own reps and Ackman claims that the company is nothing more than a pyramid scheme in which fresh recruits drive sales.

Does Bill Ackman have a valid thesis or is he just trying to save face at this point?

I'd appreciate opinions of those of you who have followed this story as it develops.

Its a straight up ponzi.

It gives incentives for reps to artificially inflate sales.

I think this is an interesting storyline. Two of the industry's giants in Ackman and Icahn going head-to-head and both have their money where there mouth is

It's not technically a Ponzi scheme, which takes money from current 'investors' to pay old 'investors'.

I'm not an expert, but do believe that the majority of sales are to distributors for the purpose of resale, but they are probably not usually resold. As people sign on new distributors, they received a commission on all sales of distributors under them, so it is a pyramid scheme/model.

None of this really matters to an investor UNLESS a government entity decides it's some type of fraud. The question isn't whether they are a pyramid or not (which they no doubt are), the question is whether the gubmint will decide they have committed some kind of fraud.

Ponzi/Pyramid, it all amounts to the same thing.

Especially when falsifying revenue to shareholders which is what they do.

They don't even actually make anything. It's a fricking joke.

Has anyone ever bought or used one of their products? Yet they're supposedly a billion dollar company?

I think the only herbalife things I've seen in the past year are written in Spanish, typically spanish phase, herbalife, and the phone number.

I would say a good litmus test would be to call the phone number, and see what they try to sell you (actual product or a distributor type deal).
