Starting a seasonal business doing some holiday decorating this year. Got some family friends who don’t have social security numbers and are looking for some work. I’d love to hire them just not sure how I would do that being my employees are W2 and on my liability insurance plan.

Would I have to pay them cash as a contractor and do 1099 with no insurance?

Pretty sure it is illegal unless they have a work visa or can provide proof they applied for a SSN

Do they have work visas? Or are they undocumented migrants seeking asylum?

You cannot do 1099 if they have no SSN. Don't get them in trouble. I know you want to right off but if they are illegal, they will tell you. Pay them cash

Can one of them start an LLC staffing agency you pay?

They'll just give you fake SSNs.

Do not create written communications with them over iMessage, or SMS. Use only Signal or similar secure method. Since they're Latino, they're all going to try to get you to use WhatsApp, but it's owned by Meta (Facebook) which likes to cooperate with the government.

Pay in cash. Do NOT Venmo, etc. Everybody else but a few of us leave their transaction history public, so I can see that some chick I worked with 9 years ago paid her friend back for tacos this weekend. After the latest IRS guidance/law changes, PayPal, Venmo, Cash, etc., all report transaction history to the IRS whether you do or not.

I can't wait for my ex-wife's accountant to figure out that having me pay for dance classes to the tune of thousands of dollars a year (ETA: via Venmo) is going to have to be explained to the IRS at some point.
