My wife (no pics) was rear ended last week. She is six months pregnant and our two year old was in the car as well.

The insurance company (Go Auto) paid to replace the car seat and provided us a rental. They also paid the OBER visit (to monitor the baby).

The adjuster called to offer a $1,000 inconvenience fee. I have never heard of that. We have NO intention of a lawsuit. My question, if we accept that (they want a release signed) would they still cover medical bills should something come up?

I regret not just filing with GEICO (mine) and letting them handle it.

Why do you have separate insurance policies? You’d get a multi line discount with Geico. And who carries Go Auto besides people with the minimum? Time to get your house in line my man.

I'm thinking he means the at fault party has go auto. And he could have filed with his and let them subrogate

The individual at fault who hit my wife’s car has Go Auto.

The release will be for future medicals. There is no other reason for the claims adjuster to just randomly give you 1k out of the kindness of their heart. You do have options though. You can accept, negotiate a higher amount, or not accept just in case you do have medical bills related to the accident at a later date.

I would wait for the foreseeable time. This won't be the last time they talk to you about signing a release. At that time you'll have more information with the health of your family to make a informed decision.

Similar thing happened to us while my wife was pregnant. I told them we would wait until after delivery.

USAA literally called while we were in the Hospital on the due date to see if everything was ok and if we could sign. They gave us around $5500

Funny that you mention Gordon on here. OP says there was no injury and has no intention of filing. Many are suggesting to wait it out and that OP can get more money out of them. One poster even said they took $5500 after being offered $1000. Gordon does exactly what everyone else has recommended that the OP do, but he gets a bad rep for doing it.

Wait. That offer isn't going anywhere.

No. Insurance companies don't offer you extra money out of the kindness of their heart. The release they want signed is a medical release that'll prevent you from suing them later.

Tell them you think you've experienced at least $2,000 worth of inconvenience.

Don't take that offer. That isn't an "inconvenience fee," it's an offer in exchange for you releasing all future claims.

Wait until your kid is born, that will be when you actually know if there are going to be any issues. I don't know what state you're in or what the statute of limitations is, but you can wait three months. Where I practice, it's a three year statute on cases like what you're describing.

Second, don't tell the adjuster that you have no intention of pursuing a lawsuit. They're already going to lowball you since you aren't represented. Tell them you'll never hire a lawyer and they'll do everything they can to take advantage of you.

Just tell them you want to keep the claim open to make sure nothing pops up in the near future and I bet you'll get a better offer right off the bat.

It’s really not about the money for us, and I do not believe there will be any surprising medical costs but I will tell him we are going to wait to see if anything persists.

no, instead of getting the reasonable 5k, gordon gets 40k from corrupt judges.
then insurance companies leave the state because of it.

Louisiana, and yes the document is titled “release of all claims with hold harmless agreement”

As others mentioned, we were contacted about what price we would consider “fair”. We said we felt $5,000 was fair. They countered with $1,500. I said $2,500 was the least amount we could do. They accepted. They also modified the hold harmless to cover any additional medical events associated with the wreck, and no longer limited at $3k.

We placed $1,250 in each of our kids fidelity accounts.

Thank you to everyone for the advice.
