you won't find me disagreeing that this credit is stupid if it allows flex fuel, but we don't make the rules, we just play by them

I've officially asked for clarification from the Governor's office and the Legislative Fiscal Office before I file any amended returns for my clients.
None of my clients want the refunds if there is any possibility at all that they will have to repay them. I cannot honestly tell them not to worry about the refunds being recalled again as my interpretation is completely different from the Policy Division. My concern is I feel the definition of the "Qualified...property" eliminates vehicles such as the Flex Fuel vehicles.
I'm no attorney by any means, however, I've researched enough laws to know how important definitions are when interpreting ANY law.

frb1951, I have stressed to my clients that there might be a possibility that the refund will be demanded to be returned. But at this point, I feel that it would be highly unlikely. So many people have now received the refund that mandating this refund would cause havoc on the tax preparers and taxpayers that it would invite legal concerns for the state. I agree with you on your interpretation of the law as this is what I have believed since I began writing these posts two months ago. Now that the Dept. of Rev. has issued a ruling on the matter, I will continue to prepare amended returns for several additional clients.

My parents filed for the credit last week and received a letter in the mail saying that the credit was declined and to call them

Is there a list anywhere to find what vehicles do qualify that weren't made in 2012?

So glad people were able to use this loophole to rob the state blind. It also got a good employee fired and replaced by the crony who pushed through the loophole to begin with. I thank all those who got the credit for their flex fuel vehicle. You have destroyed the budget yet again.
