The SEC is so much more exposed than LSU.
A court might easily conclude that the SEC’s governance structure facilitates unlawful restraint of trade and enjoin them from using the current bylaws… based on the fact that sanctions or exclusionary measures can be imposed without arbitration or evidence.
This would probably take the form of a permanent injunction, and at that point the SEC would literally be forced to rewrite its bylaws.
LSU has all the leverage.
