They said that they witnessed him away from the fight during their observation. That's pretty important evidence.
Fights aren't like the UFC. They only last a minute or so. If a witness places Jefferson away from the fight during his observation, then it simply tips the scales in Jefferson's favor.
Law is all about percentages and chances. Criminal law requires those percentages to be pretty high to convict. Placing Jefferson away from the fight, even in a limited time frame reduced the chances of a conviction.
