Is this guy as bad as a rapist? Before this case did you think it was ok for a rapist and a statutory rapist to be labeled the same?

A person that is willing to rub their balls on another person while that person is passed out in public while being video taped is a sexual deviant. Who knows what else this guy has done or would do in the future if he wasn't caught this time. I realize there are so-called straight guys (maybe 13-20yo) that do this to their friends, but at 30+ years of age if you are still doing it there is something seriously fricking wrong with you.

I never said he was above reproach. Jail time and sex offender status are extreme for this case. The latter I feel he won't be able to avoid just bc of the publicity.

You've obviously never been on probation before, so maybe you should stop right there.
And do I agree with half the laws? No. But I do appreciate that by definition, this guy premeditated a very stupid and childish act that happens to fit every definition of sexual battery and in some loose ways, rape. And then to make matters even worse, he did an equally (if not more) stupid thing by showboating it on youtube for all to see.
Albeit, what he did is a prank that 18 and 19 year old amateur drinkers do to each other. But the problem here is that Downing isn't an 18 year old kid doing it to his buddy at the bonfire behind his daddy's camp on False River.

Sober people do things they regret to. Being drunk does not create the idea of putting your balls on a stranger. The thought has never crossed my mind

I have never rubbed my genitals on another man and I've been extremely fricked up a lot of times in my past. Hell I've been to rehab twice and still never did anything of a sexually deviant behavior while I was intoxicated no matter what drug I was on.

On probation right now. Unless you are on some state/federal probation w/ a probation officer that you have to check in with he can do just about whatever he wants until he gets caught.

My wife is a lawyer (and former prosecuter) in WA state. She said you pretty much have no choice. The crime is there. You prosecute. That's how it works. Especially sexual assault or battery. I can't imagine the criminal laws in LA are much different.
Just because he thought it was funny doesn't mean he didnt commit a serious crime. I bet that passed out guy didn't think it was funny. Wierd how that works. Victims not thinking a crime is funny...

LSUZ, it wasn't NOPD. It was a facebook group combined with deadspin and a few other online media groups that were after Teabagger.
