They didn't amend it for Nebraska. Nebraska had AAU status when they entered the B1G. They lost it after being a member.

That part really hasn't even been litigated yet. The discovery process would take months to get all the communications, phone records, etc.

*ETA: to be clear, it may never get fully litigated, but it wouldn't be able to be on such a short time table. Discovery usually gets 30 days to respond and the federal suit isn't even that old.
