I love how you think there scuba, my fellow Lake Chucket. I wish we could just go back to talking about opening day of duck season (September 3, Dallas, one day only, no limit) and leave this beaten down topic alone.

I believe Sgt Stone misspoke, no charges have been filed; only a complaint has been filed by the alleged victims and I use the word victims reluctantly

He could file a civil suit for defermation of character and this would end up costing the "victims" and not the players

In order to file a defamation suit, Jefferson would have to prove that someone published (and in this context, "publish" has a broader meaning than its typical usage) an erroneous factual statement about him that damaged his general reputation in the community. Typically, in a defamation lawsuit, truth is an affirmative defense, but where the plaintiff is a public figure (and the QB of LSU may qualify as such), the plaintiff has to demonstrate "NY Times v Sullivan malice," meaning that he has to show the speaker knew the falsity of the statement or showed reckless disregard with respect to its truth or falsity. Finally, certain statements (like good faith statements to investigating police officers) are privileged under the law of many jurisdictions and cannot form the basis for a defamation suit.

Ignore the details. The point of all of this rambling is that it would be difficult for the players to sue for defamation and recover damages. Moreover, they likely would not want to expose themselves to discovery and a trial which would revolve around the very events they are trying to put behind them. Just my opinion.

Ahh, It's all making sense now. Typical government worker. You have 5 people advising you toward the wrong conclusion. All you needed was a dictionary.

Btw, its defamation

Anyone can sue anyone for anything. It would be virtually impossible for JJ to obtain a judgment.

Has anybody make a joke about defermentation?

Cause it happened at a bar?

And the participants were drunk?

Anybody make a joke about that yet. You know, fermentation . . . defermentation?

No . . . Nobody?

Okay, nevermind.

I think you just defamed the English language.

But seriously, I don't think there is any basis for JJ to claim defamation. No charges have been filed. The "victims" aren't going directly to the media and making any public claims about what happened.

All parties are lawyered up and working with the police. The only parties that could be accused of defamation are the dozens of people claiming what they saw on talk radio, the Internet, etc. Highly unlikely they'll be called to account for anything they said that wasn't true.

Methinks this is just wishful thinking on your part.
