Certainly the SEC has some rights under the First amendement regarding the association's authority as the SEC. Problem is we've got a conflict of constitutional rights - as citizens these players have constituionally recognized rights , such freedom to pursue their right to make money off of their own efforts etc. this is what NIL was all about.

As the federal judge is aware of this and the other conflicts very well presented on this forum, surely he'll dismiss without prejudice. If he allows them to amend their suit, then it will be dismissed because of the law provisions prohibiting the court from interfering with a state lawsuit as presented in this case.

Surely the SEC has to realize how complicated this case is because of the conflicts . the case is really ripe for a compromise.

The SEC thought they were going to win yesterday and jumped the gun. I don’t know how they think they can persuade a court it can execute penalties for not following bylaws when they can’t explain what their own bylaws mean.
