and to the rest of you, no it doesn't excuse a kick to the head (IF IT HAPPENED) but it does affect the nations perception of JJ.

Two things:

1) Which part of the incident was this? Inside the bar or outside the bar? Supposedly were two incidents where people were kicked out of the bar and then the brawl outside.

2) How is who started it relevant to charges of 2nd degree battery. Just cause someone swings first doesn't mean it's okay to kick then while they are down and defenseless at the end of the fight.

If they started the fight I believe the term defenseless is not as broad.

I'm not going to lie, if I was in a fight and someone called me a racial slur (if I was a minority) and threw the first punch I would probably beat the shite out of that guy and if he started to get up I would most likely kick him in or around the face.
