I would say this is the city's problem. Now if it's just a right of way through your property, then it may be a different story.

If it is a right of way, then the landowner's responsible. I just had 5 trees cut down because of pine beetles. Power lines were running through the limbs of the trees but they would not come cut the tree. They would trim the limbs but that was it.

As it turns out the tree is on my property, no doubt about it, I found the property corners and verified meets and bounds from subd plat. Assumed it was outside my property line since the trees are outside the fence line. Turns out the fence was built to avoid the trees several feet inside the property line.

If it's on your property, you are responsible. The right of way just means they can access the area if they need to but you are responsible for maintaining it.
