Im not so sure
Id at least make a phone call... Ive received broken items from them before, and they sent out replacements ASAP... didnt have to return the damaged product

when i open the case, the plastic splits and the artwork gets all fricked up and bends and shite. it's a hassle stuffing it all back into place. i sent an email to R* hoping they can just send me a case since I doubt Amazon has GTAV cases just laying around

Here's what I'd do...take an old game you hate or don't play anymore, like CoD, take the artwork out of that and burn it if you haven't already and put the torn artwork from GTAV in that case.

Why not call Amazon and explain what happened? Tell them the whole reason you ordered it through them with release day delivery was so you could play it right now and sending it back would defeat that purpose. They might offer to send you a whole new copy of the game with the agreement you'll send your damaged copy back. Or they may just tell you to keep the damaged copy.
ETA: And FWIW, I like keeping my game disc, case, artwork, and manual in pristine condition if possible.

All CoD hate aside, using an older case solves the problem unitl you really just don't notice or care about the slice in the artwork anymore.
And avoids any hassle with Amazon.
