holy 3 months awesome xbox updated bump!

and yeah.. guess it was only a matter of time. I love how these big corps can write this stuff into their ToS and then lobby the US Government to make it an arrest worthy offense to break ToS's.. yet we can't do a damn thing as customers.

Most of court jurisdictions don't hold up terms of service agreements because you arent capable of returning the item after you bought it. Example is software. Once the wrap is broken you cannot return yet you get the terms of service after it has loaded in your computer.

Companies use these to make people think they can't sue. Also, it is used to say they knew the risk.

I don't think it should be legal for companies to do this. I understand its a choice, but many companies do this to when you accept jobs. I watched a PBS documentary on it.

The Xbox policy includes a binding arbitration clause and a no class action clause. Because of Sony mainly but they are also fighting their own hacking demons right now. I'm on day 42 of no account access.

Thanks. I'm not a pissing contest kinda dude. But this really blows. They said I gave my info out on facebook or somewhere like that and may have been socially engineered. The only problem is that I have absolutely none of that shite.

I remember signing a lease for a business with release of damage wording that was so odd that I asked to take it out.. They said no.. My Lawyer looked at it and said no worries.. that wont hold up in a civil case.. so who knows.. His reasoning was that they simply couldnt wave liability just because. He showed me the case law to back his opinion and I signed it...
