They won't. Servers are on and lots of people get it this early. Only thing they do sometimes is reset stats at midnight of release day so everyone is the same.
They would only brick your console for playing burned/pirated games FWIW. They won't ban or brick as long as it is a legit copy which he has.

There are 10 prestige levels in this one. 80 ranks for each prestige. This according to the ign live stream yesterday.
