I’m a big fan of spite. Feel like this is spite done right.

“This golden masterpiece (4.9% ABV) is a limited-time release, and is perfectly paired with steamed crabs — and all other seafood! Turns out that their tears are in fact quite delicious!”

It's definitely funny.

Over and under on the number of days before PETA files a copyright lawsuit?

I would imagine they just rather it fade away and PETA vs Doughney made it pretty clear on the parody issue, I doubt they wish to go back to that well.

quote:

The court ruled that PETA was ineligible for an award of attorney's fees because Doughney did not maliciously infringe the trademark because he was creating a parody and had a First Amendment right to do so.

The PETA v. Doughney decision was based on the interpretation of the anti-cypersquatting law. One of the important parts of it was that Doughney wasn't profiting from the PETA name. In this case, the restaurant is selling a product by using PETA's name. It may still be a parody, but he is profiting from the use of the name.

Either way, it's still funny.

PETA loves publicity of any kind. The brewer and this thread played right into their hands and are actually making PETA quite happy.

They may elect to pursue a trademark claim to try to collect some of the beer profits, but that will mainly be to generate even more publicity from this opportunity the brewer has gifted them.

While the decision on domain was the rest including no award was based on 1A grounds and the court was very clear on that one.

I personally think he should donate the profits to them for the lutz, it aint going to be much.

On second thought give it to the local zoo, that would twist their tits like nothing else.
