Toho is a bitch. NOLA is a small brewery, and i'd bet they just started seeing profits maybe last year. It takes a lot of startup and a lot of expansion before you start making actual money off of a brewery. So now Toho is going to sue them for triple damages? I hope they get defeated quickly. Just more bullshite that breweries have to deal with, that no other industry really does.

Typically I'd agree with you on this. Especially when it involves two breweries that are fighting over a beer name/logo, but I have to disagree with you in this situation.

Toho is under no obligation to consider NOLA's size, age, profitability, or industry when defending their property.

On the other hand NOLA, whether they admit it or not, knowingly used the likeness to a trademarked property when they named and branded this beer.

IMO they took a risk, got caught, and are in the wrong on this one.

Cool man. I misread the post you made and was wrong in calling you out.

Still doesn't take away your terrible history posting complete nonsense and attacking people personally left and right all the time.

I agree with that for the most part. The logo is what really has me on the Toho side of this ordeal. If it was just the name I'd be more lenient on Nola.

Hopefully they re-work the recipe as well. Needs more late hops and dry hops with fewer bittering hops.

I think they should make it more like tin roof juke joint.

I don't see how they are losing money.

Some restaurant do this .. i.e. - bottomless mimosas or free refills or kids eat free on Tuesdays. They're most likely losing a little money on these promotions, but it's a loss that leads to more revenue from food so it's ultimately successful.

Not sure how that principle would apply here though.

Perhaps they see it as their super-hoppy gimmick beer that will get people to notice them, who wouldn't otherwise do so.

I agree, it's not real good, and I generally like all their other beers a lot. Seems like Hopitoulas could have done marketing-wise, what that one did, while still being a decent beer.

But, what the hell do I know?

When they have to eventually remarket and re-packaged this beer, will they make it where it doesn't taste like shite?

Taste like shite? It ain't that bad.

I enjoyed the last 4-pack I bought. It was fresher than Tom Ford.

I have had it out of the can and, to me, it was absolutely terrible. Like was said earlier .. on draft it's not that bad. I can drink a fresh pint of it and enjoy myself, but after that I'm done.

It might be a money loser in the sense that they are losing out on more money by using fermenting space on Mechahopzilla that could otherwise be used on Brown/Blonde/Hopitoulas... but I can't imagine they actually take a loss on a batch of it. That wouldn't make much sense at all.

Unfortunately I agree. Hopefully they can re-brand it and not face anything worse than changing the brand.
