Claim federal EO outweighs state.

I know the Texas legislature is going to make it a law in special session.

So what’s next?

1. EO isn’t a law
2. Is this something where Feds have supremacy over state (10th Amendment)
3. Even if 2 is true, if OSHA hasn’t actually published any rules, is it possible to claim that there is a conflict in laws until they publish it?

Pretty sure airport terminals and runways are owned by local authorities/state.

Texas could make things pretty fricking difficult for these carriers.

And if they squawk, Texas can say “What are you going to do, take your home airports with you?”

SWA doesn’t have fortress hubs but they fly heavily out of Dallas Love and Houston Hobby.

I can’t find a link to Biden’s... I found one about federal employees but nothing about private employers. Anyone have the link to the EO for private employees?

Even if the federal legislation makes a law it cannot undermine the state constitution. Would not be constitutional and would be ignored. Most state constitutions, Louisiana for example, allow for free and informed consent as well as religious freedoms. If the federal government knowingly passes a law, partisan law for sure, that forces a state to bypass its own constitution then that is a government going rogue. The constitution does not give the federal government these powers. That is deferred to the state because that allows for freedom to move to another state. A federal mandate does not give you options.

The mandate will end up before the USSC in a year or two. Between now and then a judge will put an injunction in place halting the firing of workers.


These EOs by OSHA rarely survive court scrutiny and this one has a lot of holes in it.

The SWA announcement is interesting given what was reported that the CEO said yesterday.

Abbott won't do that though, he is weak.

He needs to push the house/senate to ram through the law and then sign it, then I think its a different playing field.
