There's always a judge on duty to set bail. Guy was probably held in a holding cell, judge set bail and he bonded out without being technically "booked" into jail.

I had to stay overnight because after a certain time you had to wait until morning for the judge to set it.

DWI's are just a money making tool. and that's all they have ever been. it's like a seatbelt law on steroids.

lawyers and local gov make all the money off of it. they are designed to fleece the working man and don't really affect the connected people who will pay to get out of it, or the poor who will just sit in jail and get free room/board till their time is up.

Regardless of what happens the night of, the penalty upon conviction in LA includes a minimum 2 days in jail or 40 hours community service.

So when you see those people picking up litter, know that they are people who were too pussy to do two days in jail.

Happens - been picked up ... asked to blow.. refused .. trooper handed me a summons and told me to have a nice day I was free to go... walked out station and bought a six pack.. trooper passed me sipping on my beer while walking home .. truth - 2017

DWI but no jail?
Is this common ,

Back in the 90's I got stopped, cop told me to follow him to the station, he gave me a DUI and let my friend that was riding with me, drinking as well, drive us away to where we were going

He might not have been wasted or provably intoxicated but the cops were still really suspicious so they wrote the citation as a means to document their suspicion.
