Well her MCU character is deader than dead in the main universe, so just short of bringing back an alternate reality version, it isn't like she is going to be doing much as part of that.

And while Disney / Fox is pretty damn big, they aren't the only fish in the sea. And a lot of films are made by different production companies and then shopped to studios, so Disney may not be able to say "Can't use her" as much as having to pass on a movie they may want where she is in it.
