Hes gotten himself into a hell of a situation from the stuff I've read. I mean Bauer’s reps are angling at it was all consensual, he did what she wanted. And they do have texts to show she was into rough kinky shite.
But then you get into this legal gray area and idk the specifics of the law in California but in some places consent can't be given to break the law. So you can't cause bodily harm to someone even if they say you can. Or you get into the languages of specifically what she consented to and reasonable expectations because she likely didn't consent to or expect a concussion and skull fracture. And then there's the language of what constitutes assault which often requires intent to cause bodily harm so was it Bauers intent to cause bodily harm and should a reasonable person know his actions would result in bodily harm.
Folks, when a rando insta skank slides into your DMs and asks you to choke her unconscious and hit her, best avoid it.
