In Fulton v. City of Philadelphia, SCOTUS ruled that the city’s 2018 refusal to contract with Catholic Social Services (CSS) unless it agreed to certify same-sex couples as foster parents was unconstitutional.

Here's the opinion.

quote:

ROBERTS, C. J., delivered the opinion of the Court, in which BREYER, SOTOMAYOR, KAGAN, KAVANAUGH, and BARRETT, JJ., joined. BARRETT, J., filed a concurring opinion, in which KAVANAUGH, J., joined, and in which BREYER, J., joined as to all but the first paragraph. ALITO, J., filed an opinion concurring in the judgment, in which THOMAS and GORSUCH, JJ., joined. GORSUCH, J., filed an opinion concurring in the judgment, in which THOMAS and ALITO, JJ., joined.

A unanimous opinion on this issue is encouraging.

It also serves as a reminder that there are FAR more 9-0/8-1/7-2 type opinions than partisan 5-4 ones.

Very encouraging that all 9 came together on this. I don't always agree with their decisions and think they are too political most of the time, but kudos for this

Now apply this to Masterpiece Cakeshop v. Colorado Civil Rights Commission.

It is important to note the press want to frame this policy as “anti-same sex”, but CSS will not place kids in the homes of ANY unmarried couple.

Their policy is stated below and is in keeping with the teaching of the Catholic Church.

“ CSS holds the religious belief that marriage is a sacred bond between a man and a woman. Because CSS believes that certification of prospective foster families is an en- dorsement of their relationships, it will not certify unmarried cou- ples—regardless of their sexual orientation—or same-sex married cou- ples.”

The Most Conservative Supreme Court in years put fear in the minds of Leftists that Roe-V-Wade would be over turn and 2020 Election Rigging happened.

I encourage you to read the opinion before calling this some major win. The majority opinion is a meandering mess that basically hinges on a clause in the city’s contract with CSS allowing the city to override, or grant exceptions to, certain agency determinations. This, SCOTUS says, effectively makes the nondiscrimination policy in the contract not a general one, as required per Oregon vs. Smith. Gorsuch’s concurrence explains how the majority sidestepped the central argument of the defense by turning it into a contract issue.

Basically, a city attorney can strike a sentence in 3.21 of the contract and they can then proceed to exclude CSS from receiving contracts.

All the unanimous rulings are surprising..... just now means the dems will need to expand to 19 SC seats....

When your ruling gets overturned 9-0 by the SCOTUS , that judge should be automatically impeached and removed from the bench
