I'm not sure what your point is. They're not being prosecuted for the murder. They've already reached a plea deal. The OP is about the girls not being prosecuted. Help me to understand the distinction you are drawing

First, it is not clear that a plea deal has been finalized, but let's assume otherwise for purposes of discussion.

Please explain how they will be subject to the speculated punishments within the juvenile justice system, if the are "not being prosecuted."

The simple fact is that they ARE "being prosecuted" ... just not in the manner that most here would prefer.

As I understand it, DC law does not give the prosecutor much leeway in dealing with minors.
