Well here is a better description

LINK

and i will sum it up for you, the actions of the husband may have seen suciadal, but the police lied to the wife.

Husband went and got checked and was deemed not suicidal. When he asked for the guns back after showing the police, they refused.

He had to sue to get them back.

frick that.

In general you catcha lot of shite on here that is not always deserved. In this CASE...YOU ARE A frickING IDIOT!! THE FACT THAT PEOPLE WITH YOUR THOUGHT PROCESS EXIST, SCARES THE frick OUT OF ME.

your lack of critical thinking skills and the affects this could have in the future is the scary part.

It has to be more willful ignorance to be a contrarian than lack of critical thinking. He can makes some sound conclusions based off of the facts he accounted for. Altho frequently he either fails to observe or ignores important facts. Facts that if accounted, would greatly diminish his stance.

Let's not be bothered by the facts.

Husband and wife had fight in their home. Husband pulled gun and sounded suicidal. Wife left house and called police, asking for welfare check on husband. Police and wife returned to home, and police eventually took husband into custody for psych evaluation. Police also took possession of firearms. Wife gave permission for all of this.

In short, OP is a very, very bad description of the case, designed to rile the villagers
and of course, you are missing the headline because you want people to get buried in the details. and your characterization of the story is so far off the mark

The address of the very first home to be entered and searched without a warrant is 1600 Pennsylvania Ave, Washington, DC. If a single firearm is found at that address, the current residents should be arrested, incarcerated, and held without bond in perpetuity. Arraignment should be scheduled for February 30th.

police eventually took husband into custody for psych evaluation.

Mr. Caniglia agreed only after police promised—albeit falsely—they would not confiscate his guns while he was away. They did not have enough to involuntary commit him. They promised an action to get him to voluntarily commit himself. He was released the same day.

quote:

Wife gave permission for all of this.

Furthermore, officers then told Mrs. Caniglia that her husband had consented to the seizure, and she led them to the two handguns they owned, which were then seized. Despite Mr. Caniglia being immediately discharged from the hospital, police only gave back the firearms after he filed a civil rights case against them.

Significantly, when police confiscated the handguns, they did not allege it was to prevent imminent danger. Rather, they argued their actions were a manner of “community caretaking,” a slim exception to the warrant requirement in the Fourth Amendment of the Constitution.

They never had consent from any voluntary party. They coerced the wife into believing the spouse gave consent and never obtained written or verbal consent from any party or got a warrant.

What part of the community caretaker function was in place. The function is not to look for fruits of the crime or evidence. Which was the main point why they took the firearms. They had no reason to seize the firearms.

The Left: All cops are bad. Defund the police.

Also the Left: Let’s give cops ultimate power and authority to enter your home without a warrant to violate our constitutional rights

If they are entering homes without a warrant and without permission of the home owner and there is not an active and obvious crime being committed, then they deserve to be shot for being stupid...

If it becomes law then the cops will just be following orders.

They don’t have social workers to go get these guns?

I thoughts police were bad.....this will go over real well.

Wasn’t folks up in arms over the supposed no knock warrant for that drug dealer lover Brianna Taylor?.....ohhhh but now they want something to benefit them....so cops are good now and warrants are not even needed....makes total sense
