I believe they're going to overturn the 3-judge panel but transfer the case to another judge due to bias. Judge Sullivan should be tarred and feathered.

It is the process that Judge Sullivan has created that is unconstitutional. She has been hammering that point.

However, the technicality is discretion.

Mandamus cannot lie unless it is a ministerial act- no discretion. SP's point is that the constitution is what gives district court discretion but only to ensure that the dismissal is with prejudice to protect the defendant's rights.

Now this judge is looking for an out on the record.

The entire judicial cabal is trying to run the clock out past the election. Flynn is ultimately going to get off. There is no doubt. But it's about timing. These crooks are tying to get this past the election and are searching for ANY technicality to run the clock out.
