Trump lawyers respond to articles of impeachment: 'Constitutionally invalid'

President Trump's legal team on Saturday issued a full-throttled defense to the articles of impeachment, refuting the substance and process of the charges while accusing House Democrats of engaging in a "dangerous attack" on the right of the American people to freely choose their president.
"This is a brazen and unlawful attempt to overturn the results of the 2016 election and interfere with the 2020 election -- now just months away," the legal filing said. "The highly partisan and reckless obsession with impeaching the president began the day he was inaugurated and continues to this day."
"The articles of impeachment are constitutionally invalid on their face," the seven-page filing continued.
quote:
Trump's lawyers argued that the articles of impeachment "violate the Constitution" and are "defective in their entirety" because they were the product of invalid House proceedings that "flagrantly denied the President any due process rights."
quote:
"In order to preserve our constitutional structure of government, to reject the poisonous partisanship that the Framers warned against, to ensure one-party political impeachment vendettas do not become the 'new normal,' and to vindicate the will of the American people, the Senate must reject both Articles of Impeachment," Trump's legal team wrote. "In the end, this entire process is nothing more than a dangerous attack on the American people themselves and their fundamental right to vote."

Anyone with more than 10 brain cells could make this argument before the Senate.

Holy shite, I would be worried if they’ve gone this erroneous route.
Trump’s lawyers are attacking the Constitution, namely its sole power of impeachment to the House, the fact that it is not a criminal proceeding, and moreover, a frontal attack on the American grand jury system to which impeachment is analogous, whereby the accused is not afforded due process, doesn’t have the right of representation at the proceedings, and which further allows secret proceedings.
Wow.

If Trump 'broke the law" by withholding aid to Ukraine then Joe Biden and Barack Obama were guilty of Conspiracy to do the same, and we have Biden on video doing it.
He threatened to withhold money if Ukraine did not fire a prosecutor within a certain amount of time, which he said he had approval from President Obama to do. Had they not done so, he and Obama had conspired to do exactly that.
Quid Pro Quo, conspiracy.

Withholding aid from Ukraine isn't a crime. Especially in the face of corruption as per the bill Clinton signed in 97.
Even if it were, according to the Impoundment Act there were mechanisms included in that to settle disputes. Impeachment isn't among them.
Sorry dems, you're stupid as shite for believing you "got heem."

Wow. You fail to mention this is NOT a grand jury. It is impeachment. Rules were violated over and over during the proceedings.
This is the people's House. Not some secret grand jury and there is no reason at all any of it should have been done behind closed doors. None.

I appreciate the name-calling. It displays superior intellect.

The NYTimes article on this is pathetic. It essentially says Trump never denies the wrong doing.

I equated impeachment with a grand jury proceeding.
An impeachment can lead to a loss of office, a grand jury can lead to a loss of freedom (and perhaps your life, if convicted).
Doucheowitz and shite-stirring Starr are attacking the Constitution. They purport to embrace the grand jury system while selectively wiping their arse with other parts of the Constitution. No bueno.
What rules were violated?

Thats nice.
It also corrals that power to "High crimes and misdemeanors" akin to treason. Not sure if a bad PR move is in the same ballpark.
Do you?

the fact that it is not a criminal proceeding,
That will come as a surprise to the many talking heads on the left that have been parroting the talking point that "Can you imagine any trial in any courtroom in this country wherein witnesses aren't called!?"
Posted on 1/18/20 at 7:51 pm to Dale51
I do not, but that decision is left solely to the House of Representatives.

I fully expect a chorus of derision to your Grand Jury analogy ... primarily from posters who would also argue with you if you were to assert that impeachment is a political tool rather than a judicial one,

The left is generally scum with no moral principles. But they had the sole power of impeachment.

Especially when it was released weeks before the agreement deadline to release.
What don't people understand about this?
