That's just it. I don't accept the analogy AND nobody with any knowledge of The Constitution should either.
Agreed, but we see the argument here on a daily basis.

I SAID that presentation of evidence not used in the House should not be bothersome to those who cling to the criminal trial, analysis.
Ah I got what you were laying down Mr. Nadler.

This should come as no surprise to (and should not bother) those people who continue to assert that the impeachment process is most-analogous to a criminal prosecution.

If you accept that analogy, the House is the Grand Jury, the articles of impeachment from the House would equate to the indictment, the Senate is the petit jury, and the senate trial would equate to the jury trial.

A competent prosecutor will NEVER present all of his evidence at the grand jury stage

If you accept this analogy.... you should also agree that a competent prosecutor would not pursue a case that alleged exactly 0 criminal charges. Case dismissed.

So, you were INTENTIONALLY disingenuous. Good to know.

I have not seen any commentary about who actually does the presenting of the evidence. will they have to wake up Nadler to present or will a lawyer do the presenting. maybe this is why with the exception of nad and shifty, all of the rest of case managers are no name representatives

Or macking your thought that somehow what has happened in the House and what will happen in the Senate in any way could be considered a typical trial type process is laughable, just like Schiff and company magically found a note.

I have a question to the lawyers on this board!

Is it legit for the Senate to say we will only look at evidence/witnesses that was presented during the House hearings, since Nancy/Adam/Nads say the articles they are presenting already show clear evidence of guilt? In addition, allow the Defense to present their evidence/witnesses since they were not given that chance in the House hearings?

To me, that seems like the perfect strategy for the R's.

That basically would mean the same lame hearsay witnesses can be called, plus whomever the R's decide to call and then vote on that.

Don’t read “commentary.”

Read the “ RULES OF PROCEDURE AND PRACTICE IN THE SENATE WHEN SITTING ON IMPEACHMENT TRIALS”
