If ex-employee files unemployment do I gat a notice?

And if so how long does it take? My first time dealing with it and it has been a while I haven’t heard anything. He said he was filing after I fired him but so far nothing. TIA

It depends. Did you send LWC the notice of separation? If you didn't they'll grant him benefits by default, which you'll need to appeal. They also have generic defaults for filers. If you sent the form 77 and it didn't state misconduct he'll be granted benefits by default. If you did send the notice and it stated misconduct, but his application provided any reasonable explanation for being fired he'll also likely be granted benefits initially, which you'll need to appeal.

Then you can dispute. We've done it every time a fired employee files and I don't believe we've ever lost.

They will file for benefits faster than anything they’ve ever done at work. Uncanny.

I didn’t send any forms to LWC. Sounds like I need to. If they grant benefits by default I’d still get a notice of some sort right?

Is the employee so bad you want to deny benefits? I mean what you have already paid in on the employee you will not get back.

You will get a notice and an opportunity to dispute the unemployment. If you are planning on disputing it then you better have documentation as to why you don't think he should receive unemployment.

Someone else already said it in the thread but it's not going to cost you more money to give him unemployment.

That’s not accurate. Depending on his industry, company size, and years in business, it could have a significant impact on his UI rating.

The UI rating is going to increase anyways so it's almost impossible to understand if the increase is based on this unemployment request or government wanting more money.
