This is why the story is news. How do we legally treat cases like this?
What constitutes public menacing? What if he had been running through the store? Complaining loudly to the manager? Asking strangers about politics or Jesus?
What if somebody else shoots him in any of these activities? Murder? Manslaughter? No charges?
Can somebody now legally start a confrontation with him over the last can of spam and then legally shoot him, reasoning that the now deceased had made the first move?
From a legal standpoint, we’re moving back to the 19th century.
