Even Scalia believed this but like most of us he was concerned and cautious as to how to fix it without fricking over the gun owners.

Mr. Bird35. On March 23rd of this year, the Federal Regulatory Commission on Mental Health has revoked your right of firearm ownership. This ruling was made by a panel of licensed Federal Government mental health evaluators after you stated negative commentary about (insert any government name) on a public social media platform commonly known as Facebook. Federal Law Ennfircement is scheduled to come to your home at (address) on April 15th at 5:30pm Est to confiscate all registered and unregistered firearms. Your full cooperation is required in this matter. You have a right to appeal this decision after the initial collection of firearms has take place.

You can't legally yell "Fire" in a theater. You can't legally incite to riot.
You can't practice human sacrifice. Not sure about animal sacrifice. Can't get away with claiming your religion forbids you from paying taxes.
