It is a crime when it’s to the fbi. Which is why Flynn was prosecuted.
But it’s very likely he gets no time because of cooperation

Does that give a regulatory body grounds for a misconduct investigation or give decent grounds for an appellate hearing?

Agreed, the rights of Miranda attach in a custodial interrogation, it's completely obvious interrogating questions were asked to elicit an incriminating answer, what's murky though is that the setting as portrayed by both sides doesn't appear custodial even though the FBI's side of the story is irrelevant per applicable caselaw. Maybe I need to read up more on Flynn's side of how he felt, all accounts it appeared voluntary and all that on his part.

Why then are FBI interviews not recorded? Why then are 302's, written by FBI agents themselves, the only contemporaneous recording of what happened? If a podunk cop has to record an interview with a podunk crook in a podunk town, why is it that the most powerful law enforcement agency on Earth is exempt from the same standards?
People are pissed at how easy it is for someone to be charged with a federal process crime, have your entire history combed through and then be railroaded to plead guilty to a crime you didn't commit under the threat of decades of imprisonment for other alleged crimes that would've never come to light but for the bullshite process crime.

In my opinion, you're more than likely correct on this, yes its completely obvious interrogating questions were asked with the whole meeting thing but whether its custodial per the crim pro caselaw, circumstances don't indicate that to me and Flynn's side of the setting and context of the interview's the only thing that matters.
FWIW: I don't think Flynn should've lied however I don't think it was material for false statements when they already had the substantive proof, yes I'm aware of the capacity standard but what did this lie have the capacity to do in light of all the circumstances? Not really much, life still goes on and the investigation still proceeds as planned. IDK maybe its the civil libertarian in me coming out.
