All this over a lie the FBI already knew was a lie and had verifiable evidence to disprove and meant nothing in the grand scheme of things? Yes, Gen. Flynn shouldn't have lied dk why he would but, in my judgment, it doesn't rise to the level of satisfying the "materiality" element of 18 USC 1001 and I know the capacity standard controls per case law. Did this statement have the capacity to mean anything? It was about a meeting that was already wiretapped and checked out. I don't get the world sometimes, man.

Textbook definition of entrapment, should've pleaded it but this plea deal doesn't appear too bad and Mueller recommended a very lenient sentence, ain't no thang.

I agree. His statements on the treason stuff lead me to think he was more concerned with the Turkey stuff. I think there is more about Turkey in the sealed filings than there is about Russian ambassador.

But I agree a very bizarre hearing all around for a usually buttoned up and well-oiled federal court proceeding

The judge later clarified that he did not intend to imply that Flynn may be guilty of treason when he asked the question.

I never actually knew. By context, I took it to mean the grand plan of Flynn being the sacrificial lamb. I mostly just laughed at CptBengal when he used it because he was trying to sound all fancy and military.

Sullivan's actions today were interesting. There is always a possibility he could toss the sentence, but my take is he was leaning far to the other direction.

To be candid, there is no way in hell the lying to the FBI charge would have stuck had Flynn contested it. Just as anyone must be warned as to their rights against self-incrimination in a police interview, Flynn had the same right. The FBI clearly avoided apprising him of that. Flynn's claim that he knew "it is a crime to lie to the FBI" is technically irrelevant. He was not warned. He'd have been acquitted on that basis alone. The FBI's actions as detailed by Comey were inexcusable. Sullivan surely knows all of that.

Presumably there are other redacted aspects of the matter which set Sullivan off though.

Anyway, I agree with your take. He wanted to make it 100% clear to all that Flynn was guilty of deliberate and potentially damaging deceit, and he wanted Flynn to have another 100 days to ponder that.

But then says Flynn sold his country out, and suggested that he maybe committed Treason? I am not sure if this Judge is a swamp rat or Maga.

Mueller has already destroyed Flynn’s life, Flynn wanted out and was pleading guilty as hard as he could to a process crime with no jail time in order to get out from under Mueller. If Flynn were to recant his plea then he knows Mueller and crew are coming for him, his family, and everyone associated with him for anything and everything.

The judge knows this a sham case. Flynn is stuck in a legit prisoners dilemma, the plea is the safest route. The judge doesn’t like that fact, pretty obvious to me.

Ridiculous or not, it is the law my friend. I suspect concern about it on the part of the prosecution was basis for not being forthcoming with the 302. Comey's recent statements to that end, and about the Flynn setup, are abhorrent.
