The cake ruling isn't really a win. Too narrowly decided for that.

You know that both sides are claiming a win here right? If anything its pro-LGBTQ

"Our society has come to the recognition that gay persons and gay couples cannot be treated as social outcasts or as inferior in dignity and worth," Kennedy wrote.

But Kennedy said the state commission's hostility toward religion "was inconsistent with the First Amendment's guarantee that our laws be applied in a manner that is neutral toward religion."

Kennedy wrote that any ruling in favor of creative professionals must be "sufficiently constrained, lest all purveyors of goods and services who object to gay marriages for moral and religious reasons in effect be allowed to put up signs saying 'no goods or services will be sold if they will be used for gay marriages,' something that would impose a serious stigma on gay persons."

Sure it is. These people lives were ruined by the lawsuits that were filed against them. They may not sell any more cakes but they sure will get their due in court.

how is this a trump win? wasn't it a supreme court decision? 7-2 so the justice he added wouldn't have made a difference. it's a win but not a trump win

99% of the people who support the bakers support this.

Meanwhile, 100% of the anti-baker people oppose it.

If the only issue was not being allowed to put up a sign refusing to serve ANY gays........this wouldn't even be a famous issue.

Every single famous case has required either
1. The contractor(cake, photographer etc) to either create something unique to a gay event

or

2. Contractor participation in said event.

And, there's really no way after this ruling to continue to force either 1 or 2.

It only extends to creative professionals. You can't be forced to create art for a gay wedding but a catering company, for example, would typically be on the hook.

Not really. Catering requires presence at the event. That's going to run into exactly the same problem spelled out in this case.

It's simple.

To pass muster, if you read Kennedy........you can't be playing "good for you........but not for you" games with the religious.

So cool. You set a policy and someone tries to get the catering company for a gay wedding. Great. The local authorities will be all over that.

But NOW, the path is laid. What we'll see is some enterprising conservatives doing exactly what the gays have done.

They'll seek to get known gay companies to support events they know the companies will find objectionable.

And viola. Local authorities will do the same stupid shite they did here and only go after the religious.

And, if per chance they actually try and shoot fair.........the fricking gays will lose their goddamned minds!

Win either way.

Awfully presumptuous with such a narrow ruling. The baker successfully claimed his special order cakes were a personal expression of art and his beliefs.

That won't work for most goods and services.

Not sure how this is a "Trump win"? The justice he appointed replaced Scalia, who almost assuredly would have been in the 7-2 majority on the opinion. It's not as if Gorsuch "tipped the scales" on this decision.
