But the insurance company paid the contractor. The contractor has to submit papers to the insurance company on work completed. That's fraud and directly involves the insurance company.

No they paid the insured, the insured paid the contractor.

the insurance co did not pay the contractor, he paid the HO's benefits due to him from his RCB's

in very rare cases such as water mitigation (where time is of essence) does an ins co directly hire or recommend a contractor.

I have been getting 20-30 claims a week for the last 2 months, driving 1500-2k miles a week. They finally found me some help and transferred 20+ from me yesterday. I am so happy.

I had to learn the hard way, but I would rather eat the $800 than allow that incompetent bastard back on my property.

Well first let's all be aware we are only getting one side of the story. Maybe the OP was an a-hole or unreasonable , we don't know that.

And to the OP regardless of what the insurance estimate says what matters is what does the contractors proposal to you state? Does he specifically state in his proposal or contract with you that he is removing existing flashing and fabricating and installing new flashing?

If so, he owes you, if not he doesn't owe you shite.

And good luck getting him to pay if your relationship with him is done. Chalk that $800 to experience and save the $2k you will spend to fight it. I've been know to burn the house down around me from time to time in order to prove a point and am not afraid of a Pyrrhic victory but I also know when it is time to do it and when it is time to fold the cards and move on.

I know this is a tough lesson. but the next time you need a contractor come here first, get recommendations and then check their references

Lots of reputable roofers around
