I'm sure some parents out there will mark non-binary or whatever at birth but I imagine this 3rd option will come into play for people who down the line as adults want to amend the birth certificate. I think it's bonkers, but I imagine that's what they had in mind when they drafted this.

exactly

why subject your kids to unnecessary future legal fees?

why even create the false premise in their mind that this is a decision that they need to even concern themselves with?

that stress is completely unnecessary

That and rare cases where children are born hermaphrodites or with abnormal chromosomes. I think doctors have been growing more reluctant to perform corrective surgeries on these newborns as sometimes they pick the wrong assignment. This would make it easier to defer to adulthood, although I bet the corrective surgery is more complicated by then.
