Was the 4 page thread below your thread not good enough?

First and foremost, let's hope he is okay. Whether he plays football or not is inconsequential at this point. With that said, if he is a medical retirement, a settlement will be reached and the majority of that contract will not count against the cap.

there's no "settlement" that's going to be less than his "guaranteed" part of his contract. 8 or 9 mill i believe but i'm not a capwiz.

Actually, for retired players, there is the so-called "Barry Sanders rule."
Basically, the signing bonus is upfront money for performance in future seasons. If Fairley retires, the Saints can collect the signing bonus back. Now deals can be worked out or the Saints can decide to eat the money, but if the money is returned, there should be a salary cap credit for the team.
So, I think it would be fair for the Saints and Fairley to agree to a return of $6,000,000 for the future years under the signing bonus in exchange for his base salary ($1,000,000) and this year's portion of the signing bonus ($2,000,000). All in all, Fairley would have been paid six million for 1 year's worth of games for the Saints while the Saints get some refund from the contract.
I could give a more concrete answer but I don't feel like reading the CBA again.

How do we extend (re-sign) a guy with a horrible heart condition....RED FLAG!!
Not to beat a dead horse, and not a homer thing but we couldn't spend a 7th Rd pick La'ell Collins because of a "red flag".
Marcus Peters for that matter.
Both positions of need that have been the difference between a couple of wins the last few years.
The medical staff on this team is horrid!

Oh really.
Someone needs to go back 17 years and tell the arbitrator: LINK
quote:
Arbitrator Sam Kagel ruled that Sanders owed the Lions only one-sixth of the $11 million bonus he received in 1997 because he's missed only one season so far.
Unless he returns to football, he will owe $1.83 million on future reporting dates.
NFL CBA 2011-2020
Section 9:
quote:
(vi) Retirement.
Should a Forfeitable Breach occur due to player’s retirement, a Club may demand repayment of all Forfeitable Salary Allocations attributable to the proportionate amount, if any, for the present year and the Forfeitable Salary Allocations for future years. If the player fails to repay such amounts, then the Club may seek an award from the System Arbitrator pursuant to Article 15, for repayment of all Forfeitable Salary Allocations attributable to present and future years. Repayment of Forfeitable Salary Allocations attributable to future League Years must be made by June 1st of each League Year for which each Forfeitable Salary Allocation is attributable. If the player returns to play for the Club in the subsequent season, then the Club must either (a) take the player back under his existing contract with no forfeiture of the remaining Forfeitable Salary Allocations, or (b) release the player and seek repayment of any remaining Forfeitable Salary Allocations for future League Years.
Recent example:
Chris Borland
quote:
Borland received a $617,436 signing bonus when he inked a four-year rookie deal with the Niners coming out of college. He'll be returning $463,077 to the team assuming his three-quarters number is spot on.
That's a huge chunk of change, but it's likely the 49ers could've recovered it from him anyway, although litigating the money back from Borland would've been a messy affair.
It's an option but it's not imperative as it can lead to bad P.R.

Peters pissed me off, but collins made it public he will not sign with a team unless they take him by the 3rd. Per nfl rule; if a player does not sign with the team that drafted him, and there is no trade orchestrated then that player can enter the following years draft. I dont know about the supplemental draft rules. Basically collins was willing to wait if a team drafted him past the the 3rd.

He probably has a sports hernia, too.

Retiring due to injury and retiring due to disliking your team and or not wanting to play anymore are different situations.

Yes, they are different but are treated the same under the CBA.
Here is the section specifically for retirements:
quote:
(vi) Retirement.

See no distinction regarding the retirement.
Article 4, Section 9 - deals with forfeiture; starts on page 12 of the CBA which can be found here.

You can add Calvin Johnson to that list too. He paid back over 1m of his signing bonus.
Like I said previously, they will come to an injury settlement. The team could demand the whole thing back, but that leads to bad PR. Fairley's agent knows this, so they will probably let him keep 1-2m of the bonus and it will be accelerated to this year's cap.
