I think that it would be an assumption that he agreed to the syllabus if he didn't drop the class and didn't raise any issue about said policy before the incident.
Is that an expressed condition of the syllabus?

Someone start a GoFundMe to get his arse to an SEC real college instead of a lefty looniversity. He could even attend Misery so as not to be completely culture shocked.

Hope OCC has some good lawyers.

Did him a favor. He should re-evaluate and attend a college that will give him an opportunity for gainful employment.

Just looked and CA is a two party consent state.
Here is the applicable law: LINK
Where I would make an argument is here:
If you are recording someone without their knowledge in a public or semi-public place like a street or restaurant, the person whom you're recording may or may not have "an objectively reasonable expectation that no one is listening in or overhearing the conversation," and the reasonableness of the expectation would depend on the particular factual circumstances. Therefore, you cannot necessarily assume that you are in the clear simply because you are in a public place.
And,
If you are operating in California, you should always get the consent of all parties before recording any conversation that common sense tells you might be "private" or "confidential." In addition to subjecting you to criminal prosecution, violating the California wiretapping law can expose you to a civil lawsuit for damages by an injured party. See Cal. Penal Code § 637.2.
Would be interested in what the professor's damages would be in a civil suit.

Of course. We're through the looking glass, people. Up is down. Black is white. Night is day.

A professor in a classroom should not be expecting the lecture to be considered private.

Yeah..... in court we would be.

Am I the only one here who would write "frick YOU" 1000 times and turn it in as the essay?

No recording policies are a thing, not sure why you're getting downvoted (besides not engaging in the rabble).

No recording rules are pretty common in college today.
You're not fooling anyone dumbass.

Section (c) of the California Penal Code appears to agree with you:
[i](c) The term “confidential communication” includes any communication carried on in circumstances as may reasonably indicate that any party to the communication desires it to be confined to the parties thereto, but excludes a communication made in a public gathering or in any legislative, judicial, executive or administrative proceeding open to the public, or in any other circumstance in which the parties to the communication may reasonably expect that the communication may be overheard or recorded. - See more at: LINK ]
This will all come down to a lecture either being given the status of confidential communication or not. Good luck with that OCC.

Yeah... that... or professors want to protect their lectures from being replicated since they are private content.

With you, but I'm researching this based on the college's perspective. When I'm looking to wreck someone's argument I generally like to be able to make their case better than they can.

Isn't it interesting that libtard progressives always want to film law enforcement or others that they accuse of being "facist", but always object to being filmed by others?
Take a look at all of the videos on YouTube where leftists object to being filmed. It's almost like they have something to hide?

Meh, it was right there in the syllabus not to record.
No one was forcing him to take that shite arse class at that shite arse college.
Here's the headline for their football web page:
"Six more Pirates take their game to 4 year level"
