On that day, early in the morning, CCPD executed a no-knock search warrant, forcing entry into the home without first knocking and announcing they were the police.

A flash bang grenade was fired into Rosas’ bedroom, reportedly stunning the 47-year-old, who then opened fire on the intruders. Three officers were wounded; officers Steven Ruebelmann, Steven Brown, and Andrew Jordan. Police were looking for drugs and Rosas’ nephew, who they suspected to be a dealer. However, the unnamed nephew was not home at the time of the raid.

Rosas spent nearly 2 years in jail awaiting trial, which concluded Tuesday with a Nueces County jury finding him not guilty. Rosas’ defense maintained, based on statements he made immediately following the shooting and later in jail that he did not know the men breaking into his home were police officers and there was no way he could’ve known, having been disoriented by the flash-bang stun grenade. “The case is so easy, this is a self-defense case,” said Rosas’ lawyer in closing arguments.

Rosas originally faced three counts of attempted capital murder, but the prosecution dropped those charges just before the trial began, opting instead to try him for three counts of aggravated assault on the police officers. The jury sided with his defense attorney’s argument he had a right to defend his home and found him not guilty on all charges.

Why in the hell was this even brought to trial? The cops broke into his home and threw a freaking flash grenade without announcing themselves!

Id be pissed if I spent 2 years in jail waiting for a trial.

This was dumb, the system worked except for that whole speedy part.

Was there no bond or was it astronomically high? Sounds like BS that a guy would have to spend 2 years in jail unless he was a flight risk. Maybe he had priors or something but frick that, 2 years gone for some small man complex wanna be tough guys breaking into the dude's house. That's what it should be too, unlawful entry and those cops should face charges.

POS prosecutor thought they were gonna go hard with the original charges then realizing the pigs shouldn't have broken into the guy's house tried to get him for something to show taxpayers they didn't waste their money. Now more taxpayer money is going to pay this guys $$ for being locked away from his family for 2 years.

Now that case precedence has been set, I hope law enforcement thinks hard before executing a No-Knock in the future.

So after two years list and God knows how much money wasted on lawyers, he got his freedom back. The system works?

No knock warrants are bullshite as far as I'm concerned. The fact that they are being used in pursuit of non-violent offenders as opposed to being reserved for rare and extremely dangerous suspects is outrageous.
