They can protect their trademark however they please. They can choose to shut down one school while not going after another if they want

They probably do. People have to understand, if you have something trademarked but don't actively defend that trademark it could be an avenue for someone to illegally use it based on the grounds that you didn't try to protect it in the past.
Like a poster said, sometimes they let them use it, especially when it follows a similar color scheme because it's not diminishing the brand.

Texas went after a San Diego high school a few years ago.

Nope
They need to protect their logo as they fit, and seem like they are willing to give them a reasonable timeline to phase it out.
