If he said he didn't shot him, then there is the "innocent until proven guilty". The point of him killing Will Smith is not in question so the prosecutor does not have to prove the action that took place.
From outside I have yet to see anything that says he had any justification in shooting a guy in the back and killing him. He now has to prove his life was in danger enough to shoot a man multiple times in the back.

What will happen to the NOPD cop/friend of Smith if the defense's witness that claims to have seen him tampering with the gun/evidence at the crime scene is legit?

This whole thing seems outrageously fishy.

To a reasonable person, it's looking more like a drunk-driving Smith fled an accident, and then in an intoxicated rage provoked (or at the bare minimum, co-contributed) this incident. But I'm sure we'll find out a lot more as this whole thing progresses.

I don't care if he blood level was . 100 . The shooting was not justified was not self defense a cowardly act .
