You're probably trolling, but there is no reason any business owner should have to accomodate anyone for any reason if they don't want to, and especially if they can't afford to.


The cripple should take his misarable arse somewhere else.

I don't think that's true. The CRO (I think?) will look to see if the business owner attempted "reasonable accommodations". Building a ramp and striping the lot is a "reasonable accommodation", but having to construct an upstairs bathroom at a cost of X% more than your monthly revenue likely falls outside that parameter. His failure to accommodate at all will bite him in the arse.

But it's all moot if he's unwilling to hire a lawyer to file his claim response and explain his limitations.

That may be a good attitude to have as a customer/consumer, but it would get the business owner sued or bankrupted very quickly.

You have to make accommodations all the GD time, unfortunately.

I represented a national Pizza delivery chain secondary to what was basically an extortion letter. The Complaining party was handicapped and threatened to sue but said he would settle for $ 5K.

I told them no worries....stay home....we would deliver him a Pizza.

One of the funniest letters I have ever written as an attorney.

when these frivolous suits fail the plantiff should be held accountable for damages and legal fees.

This is an activist push by the attorney's representing handicapped individuals. I manage a shopping center and there have been multiple visits to shopping centers in the area informing business of their intent. This is about cash.

I kind of slightly know the guy, doesn't really seem the type to want to cash in.

He's been on the news before advocating for Lafayette to be more wheelchair friendly, as far as sidewalks go.

Is he suing them for damages, or to make them put the stuff in? I mean this is likely a lose, lose for him. If he isn't suing for damages, he won't get paid. If he wins his suit and the guy can't afford to move the bathroom, he closes, and the guy still can't go to Bisbano's.

Just go get your pizza somewhere else. Brisbano's needs to post a "we reserve the right to refuse service to anyone" outside their front door.

But I do feel bad for the wheelchair dude.

I don't know but it seems like if you let the guy in and don't let him use the bathroom than you are opening yourself up for a discrimination lawsuit.

Wouldn't it be better to just not build the ramp? Interesting question but still a bullshite lawsuit.

It sucks that he has to pay someone to explain his limitations. It shouldn't be that way. You shouldn't be forced to fork over cash every time someone has a grievance with you.

I lived on Bisbano's when I was at ULL. It would suck if they have to close.

But it's true. The place is a nightmare for handicap accessibility.

The thing is, it's not frivolous. He has a good chance of winning if the business isn't ADA compliant.

It sucks, because I love Bisbano's.

The ADA laws aren't retroactive. I don't think he has a snowballs chance in hell of winning.
