True, and that's why it would be scary as hell. They would have to try everything they could to figure out a way to take him out. How they could do that, I haven't a clue.
But in real life normal people would be S.O.L if folks had those kinds of powers. It would be way too dangerous to just allow folks like that to just go about as they please, because real life superpowered people would be way too tempted to abuse their powers.
ETA: Magneto's theory on how humans would react to mutants, and his drive to "conquer" humans is probably pretty accurate to what would happen with superpowered people in the real world.

I'd have to be PRO. In the mutant world, wasn't it like only 1% of the people that had powers? That'd be over 2 million in the US alone. So maybe not that many. But those type of powers are dangerous and the mutants/superhuman couldn't just walk around unchecked. There would have to be ways to keep them inline, identify them when they do wrong and capture/punish them. Dare I say..
