Those things aren't a crime. (Unless in a state where it is illegal to be on the phone and drive.)
Assault is a crime. The intent was not murder, but the intent of assault was there. Deal with the conequences. 8 years for a crime resulting in death is more than a fair sentence.

im not trolling, and im not trying to be insensitive. I know he did something wrong, something bad happened because of it. He is responsible for his actions. He needs to be punished. I just dont think 8 years is helping anyone in the situation, unless this guy had some sort of history of violence or something.

He punched a referee in a recreational game because he was mad at a call.
That's enough of a history of violence in my opinion to warrant locking up a murderer.

i 100% agree with the charge you are right... i just think the 8 years is extreme for an isolated incidient "if that is the case"

Habitual criminal or one-time offender? Because the purpose of imprisonment is either to remove the offender from society, punish the offender or serve as a deterrent for society as a whole.
As a deterrent, it's pretty mediocre. Punishment is hit or miss really and isn't really satisfying. Removal from society is probably the best reason, but does society benefit from the removal of one-time offenders or does is suffer?

any individual's death is an "isolated incident." only happens once. and as mentioned above, it last a lot longer than 8 years. whether or not the violent act was intended to cause death, it did. he should have known it could cause death, because shite happens. any time you strike a person, you open yourself up to that risk. he took it. it may have been a fluke, but that doesn't matter to the dead guy or his family.
as a side note, I'm starting to believe that the stupider the reason for killing someone, the stronger the sentence should be. a red card is a damn dumb reason to take a life.

So if I walk up to you and punch you resulting in your death, I should get no jail time? Just because it was during a sporting event doesn't make it ok.

like i said later on down, i need to reword my original post. He doesnt deserve that much time. I understand what he did, and he has to serve whatever punishment he got. 8 years just seems a bit much for this.

If you attack a referee because of a decision he made during a game, you deserve jail time, regardless if he dies or not.

then i 100% agree with the verdict and he deserves every year he gets. I did not know the whole story. Thank you for clearing that up, im now sure that is why he got the 8+ years. I take back everything i have said earlier in this thread

Well, someone is dead. Someone usually has to pay the price.
This is why I discourage fighting. You never know if your punch is going to cause severe damage or bleeding which results in death. If that happens, chances are the DA isn't going to let it go.
