There are exceptions to the rules of having a search warrant. The fire department and law enforcement routinely and legally make forced entry into structures without warrants.

I am usually first in line to defend the police, but, and this has been asked before, WHY make a check on someone at midnight? Did they get the call to check on him at say, 10 PM?
Also why didn't the family check on him themselves?

I will say this: If I am in my bed at midnight and am awakened by someone breaking into my house and I don't have hearing aids on to hear what they are saying they would have to shoot me too. I would be shooting .
It sounds to me like some body played cowboy.
This really sucks.

my life must not matter.

This man is a senior citizen with a heart surgery and he values his life so much that he has a gun to protect himself.

I am not a senior citizen and have not have heart surgery and I must not value my life because I do not have a gun to protect myself.

I hope this sounds as good in a post as it did in my head.

They do.

Failing to answer your door in a wellness check is not one of those circumstances, cop.

No matter how bad you and the rest of the tacticool crew want it to be.

Forget about the time and his age, it was a person recoveringfeom surgery!

I would expect them to be unresponsive and not hopping around answer doorbells that are too deaf to hear.

Most cops are high school grads at the most and are just fricking dumb.

As I said earlier somebody played cowboy and this sucks. I am only 10 years younger than the man that was shot. I don't have any health issues, but I do need hearing aids. Midnite and mfers are knocking down doors in my house and all I hear is yelling? I'm shooting.
If the old guy was recovering from heart surgery you have to guess that he is medicated on top of everything.
They should put that cop in jail and question the wisdom of making a health checkup at midnight.
Stupid shite right there.
I can hear the conversation: "Ok we got a call to check on some old guy in the hood. Lets suit up , take the weps and get the FD to break down doors if he doesn't answer. Someone has a gun shoot his arse."

Another reason why calling the police is almost always a bad idea. The reasons I can think as to why I'd call them is growing shorter by the day.
