Cases involving breach of the CBA are governed by federal law, but Gordon's claim would be predicated on violation of OH law indepedent of the CBA and thus would not be preempted by federal law.

This was the big ruling from the 8th Circuit in Starcaps.

Attorneys for Browns receiver Josh Gordon are "considering a lawsuit against the league that would include seeking an injunction to put the [one-year] suspension for violating the league's substance abuse policy on hold while the legal process plays out," reports Fox Sports. However, litigation would be a gamble that would endanger Gordon's chances of reinstatement, the report said.
