The funny thing is congress intentionally wrote in the legislation that states that do NOT implement state run exchanges will not be eligible for subsidies. Subsidies were the carrot congress was dangling in the states' faces to entice them to implement the exchanges.
Now that the initial phases of the ACA are in full effect the federal government has neglected the law and are doling out subsidies to the 34 states that have not implemented exchanges despite the plan language In the law..
We are now at the point with the ACA where the federal subsidies are essentially required for the long term survival of Obamacre. Without the subsidies low income families (much more than half) won't be able to afford health insurance.
So here we are, with tremendous pressure on the judicial system to perform legal gymnastics to rule in favor of HSS which will be plainly tantamount to legislating from the bench.
