Tuscaloosa Marine Shale - Mineral Rights

My Dad has about 150 acres in Amite County, MS just outside of Liberty, Ms. They're drilling about 2 miles from our farm (our property isn't in the pool for this well but we're close). My dad doesn't even know if we have mineral rights on our property. We've had it for about 15 yrs and he really just doesn't care. I guess he's comfortable enough!
What's the best way for me to check to see who owns the mineral rights?

Go to the courthouse in Liberty or hire a landman to research records for you

I wish it was easy as going to the courthouse.I went last year for the same thing.They show yyou they file cabinets and you search on your own.The clerk is just a clerk.

Yea I don't see my dad going through all that trouble, he's almost 70 and says he has better things to do. I would like to look into it for him but I live in Houston so I guess it'll be a little hard to get down to the courthouse!

Here in Alabama it was revealed in a recent article about a subdivision that is experiencing the houses sinking a bit. After research one homeowner found out that he owns his house and basically the surface land but mineral rights in Alabama are mostly owned by huge corporations. They are drilling diagonally under the neighborhood and in and around old mine shafts under the subdivision. His house has sunk a few inches on one side. It was also stated in the article that, legally, the house can sink over 3 feet before it is considered damaged. Ho Lee shite. Batman!

Where is the land?
There is an attorney in Liberty named Reggie Jones.His office is next to the courthouse.He should be able to help or point you in the right direction.

Guess you need to look into hiring a landman to do the dirty work for you

Basically Hwy 48/Enterprise Rd. He's not really interested in leasing it though, he's running cattle out there. He retired about 15 years ago and that's what he does for fun nowadays.

I've got a friend who's a landman here in Texas, maybe he can do some digging around for me. Thanks for the advice!

If your Dad hasn't been contacted to lease his minerals by this point, chances are he doesn't own them.

In Mississippi, unlike in Louisiana, reserved mineral rights do not revert back to the surface owner after 10 years of non-use.
If he has any mineral rights, and the oil companies are interested, they will come to him.

That was my thought as well. Though he said he's been contacted 2-3 times in the past 3 years but he's just never followed up with them. So I don't know what to think...

If he does own the minerals and doesn't lease he'll be force pooled. Force pooling in Ms only requires I think 33% of leases signed. He'll get the same as what te owners signed but won't receive royalties until the operator has recouped 300% of your dads share of the well cost.
As far as searching records. I think Amite Co recently went online with theirs. Cost about $1k a year for a subscription but most landsmen in the area have already paid that so you may be able to get one o search for a fee.
