Potentially** the driver could have a BAC of .02 and be charged with vehicular homicide. He is under 21. So 2 beers could get him sent up for 30 years. Scary shite.

I'm not going to act like I haven't driven drunk and the VAST majority of you fricks have also. Luckily I didn't injure anyone, including myself, but if I would have I damn sure would not have been grinning in my mug shot and having a few fricking beers while I talked to the sister of the young man I killed

I took that part of the article as saying he had a few beers prior to driving and was checking facebook when he crossed the centerline.

Well, I guess the good news for you is that he won't spend more than 5 years in prison regardless of BAC. I think that's a pretty short sentence for taking the life of a teenager.

Here is an interesting scenario for the TPOS people: Being on a cell phone is far more dangerous then driving drunk. So if one kills someone while texting, are they a POS as well? And is anyone who used their phone in the car a POS? I am not attacking anyone as this had been a good discussion

People make mistakes and people die. If he was a habitual offender he would be a TPOS.
What about people who are completely sober and fall asleep at the wheel or are distracted for a moment and cross the centerline and kill someone...TPOS or just a good person causing an accident?

Look, I understand people do stupid shite, I understand we all do things that we don't think of as dangerous but are.. I've just seen enough people get killed from being stupid that I choose not to.

that's very scary especially he was checking facebook. .02 in my eyes is no different than driving stone cold sober.
